What is a Special Victim Counsel?

Special Victims Counsel (SVC) are legal assistance attorneys who have received special training and are designated by the Staff Judge Advocate as SVCs.

  • An SVC’s role is to zealously represent you.  This means, an SVC’s primary duty is to you and no other person, organization, or entity.

  • SVC will work to empower you by fostering your understanding of the military justice process and providing you with legal assistance.  This will be accomplished by providing effective and timely advice, being available to assist throughout the entire military justice process, and providing appropriate advocacy to ensure that the rights you are entitled to are fully realized.

  • The mission of the SVC is to provide you with confidential legal representation related to issues that may arise as a result of being sexually assaulted.

TRIAL DEFENSE SERVICE

The United States Army Trial Defense Service’s mission is to provide a full-range of defense legal services to Soldiers. These services include:

  • Representing Soldiers charged with violations of the Uniform Code of Military Justice (UCMJ) at courts-martial and Article 32 pretrial investigations;
  • Representing Soldiers during criminal investigations and before elimination or grade reduction boards;
  • Counseling Soldiers regarding pretrial restraint, nonjudicial punishment (Article 15s), and various adverse administrative actions taken pursuant to military regulations.

Defense Counsel and Paralegals

The Trial Defense Service (TDS) is part of the U.S. Army Judge Advocate General's Corps and was established in 1980 as a separate activity of the U.S. Army Legal Services Agency. To ensure objectivity and fairness, TDS counsel are completely independent of local commands and the post legal advisors. They are supervised and rated by their superiors within TDS.

For Reserve (TPU) Soldiers our local counterpart is the 154th LSO. They can be reached at 703-960-7397. They also drill the second weekend of the month.


Routine TDS Briefings

Tuesday and Thursday 0900: Article 15s (call to confirm an appointment)
Tuesday and Thursday 1300: Chapters (call to confirm an appointment)

Note to Units: Soldiers attending briefings will need a complete packet. The Defense Counsel cannot advise the Soldier without all documents stating the charges the Soldier is facing. For Soldiers pending nonjudicial punishment (Article 15s) there should be an initial reading done by the commander or their representative along with the commander’s signature prior to the Soldier being seen. For Soldiers pending separation under AR 635-200 (Chapters) there should be a notification done by the commander or their representative along with the commander’s signature prior to the Soldier being seen.

Military Justice

Mission

The Military Justice Section's mission is to provide full spectrum of military justice support which includes advising all Commanders and Senior Non-Commission Officers within the National Capital Region, prosecuting courts-martial, assisting victims, adjudicating adverse administrative actions, and instructing in preventative law.

The typical actions the Military Justice Section handles include:

  • Prosecuting violations of the Uniform Code of Military Justice in Special and General Courts-Martial
  • Assisting law enforcement during the criminal investigative process
  • Preparing and assisting in the adjudication of Non-Judicial Punishment
  • Drafting of Letters of Reprimand
  • Advising, preparing, and representing the United States in Administrative Separation Boards
  • Acting as a liaison between Commanders and civilian prosecutors

ADMINISTRATIVE AND CIVIL LAW DIVISION

Mission

The Administrative and Civil Law Division provides premier legal advice and support to Commanders and staff in a variety of areas. These include civilian personnel and labor law, contract and fiscal law, environmental law, federal litigation, the Freedom of Information and Privacy Acts, the Joint Ethics Regulation and Federal ethics laws, military administrative law (e.g., 15-6 investigations, line of duty investigations, and Financial Liability Investigation), and military personnel law.
